Terms of Service

These Terms of Service ("Terms") govern your use of boldhead.net (the "Site") and every order you place with Boldhead. Together with our Privacy Policy, Shipping Policy and Refund & Returns Policy, they form the agreement between you and us. By browsing the Site or placing an order you accept these Terms; if you do not accept them, please do not use the Site.

1. Who we are

Boldhead is the trading name of ERJHG ED LLC, located in Chandler, AZ. We sell Active Lifestyle Essentials products through this online store.

2. Who may order

You must be at least 18 years old, or have the permission of a parent or legal guardian, to use the Site or place an order. You agree that the information you provide when ordering is accurate, current and complete.

3. Products, prices and availability

We sell Active Lifestyle Essentials products as described on their product pages. Listings may be changed, updated or withdrawn at any time without notice. All prices are shown in US Dollars (USD) and exclude sales tax unless stated otherwise; the full amount you will pay, including tax, is displayed at checkout before you confirm. We may update prices at any time, and we reserve the right to correct pricing or description errors, including after an order has been placed, in which case we will tell you and give you the option to cancel.

4. Orders and acceptance

When you place an order you are making an offer to buy the products in your cart at the prices shown. We confirm receipt by email, and the contract is formed when we dispatch the goods. We may decline or cancel an order before dispatch, for example where a product is unavailable, a pricing error is found, or a payment cannot be verified; in that case you will be told and any amount already charged will be refunded. If you need to cancel, contact support@boldhead.net as soon as possible; orders that have already been processed or shipped may no longer be cancellable, and would instead fall under the Refund & Returns Policy.

5. Payment

We accept Shop Pay, Apple Pay, Google Pay, PayPal, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken securely at checkout through Shopify Payments, over an SSL-encrypted, PCI-DSS compliant connection; we do not store your card details. Everything you are charged, including any applicable sales tax, is shown before you confirm; there are no hidden fees. By submitting payment you confirm that you are authorised to use the payment method provided.

6. Shipping

We ship to all 50 US states only; international shipping is not available. Standard shipping is free on every order with no minimum. Full details, including processing and transit times, are in our Shipping Policy.

7. Returns and refunds

Returns are accepted for manufacturing defects, transit damage or a wrong item received, within the window and under the conditions set out in our Refund & Returns Policy. That policy explains eligibility, deadlines and the return procedure.

8. Your account

If you create an account you are responsible for keeping your login details confidential and for everything done under your account. Tell us at support@boldhead.net immediately if you suspect unauthorised access.

9. Acceptable use

You agree not to:

• use the Site for any unlawful or fraudulent purpose;
• interfere with the security, integrity or operation of the Site;
• scrape, copy or republish Site content without our written permission;
• upload viruses, malware or other harmful code;
• attempt to access any part of the Site or its systems without authorisation.

10. Intellectual property

All content on the Site, including text, product descriptions, product images, graphics, page layouts and logos, belongs to or is licensed to Boldhead and is protected by copyright, trademark and other intellectual property laws. You may view and print pages for your own personal, non-commercial use in connection with shopping on the Site. You may not otherwise copy, reproduce, distribute, modify or create derivative works from any part of the Site without our prior written consent.

11. No warranties

The Site and the products are provided "as is" and "as available". We work to keep the Site accurate and reliable, but we do not warrant that it will be uninterrupted, secure, error-free or free of harmful components, or that product descriptions, images or other content are complete or current in every respect. Product colours may appear slightly different on screen than in person. Nothing in these Terms limits any warranty or right that cannot be excluded under applicable law.

12. Limitation of liability

To the fullest extent permitted by law, neither Boldhead nor ERJHG ED LLC is liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or from any product purchased through it, including loss of data, revenue or profit, however caused and whether or not we were advised of the possibility of such damages. Where liability cannot be excluded, our total liability to you for any claim relating to an order is limited to the amount you paid for that order.

13. Indemnification

You agree to indemnify and hold harmless ERJHG ED LLC, its officers and employees from any claim, loss or expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.

14. Privacy

How we handle your personal information is described in our Privacy Policy, which forms part of these Terms.

15. Changes to these Terms

We may amend these Terms at any time by posting the revised version on this page with a new effective date. Using the Site after a change is posted means you accept the revised Terms, so please review this page from time to time. If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.

16. Governing law

These Terms are governed by the laws of the State of Arizona and of the United States. Any dispute arising from these Terms or from your use of the Site will be heard by the courts located in State of Arizona.
